Preamble

In these General Terms and Conditions, “SEE” refers to See Tickets AG. On the website https://www.seetickets.com/ch (hereinafter referred to as “Website”), SEE, acting as an intermediary, sells all tickets on behalf of the organisers, promoters, artists, venues, or event producers (hereinafter referred to as “Promoter”) in accordance with these General Terms and Conditions and which are subject to all other applicable terms, conditions, and regulations pertaining to the event.

1. Ticket Purchase

1.1. The ticket purchaser acknowledges that all rights and obligations, including but not limited to those arising from the purchase of tickets and in connection with the event, are solely between the Promoter and the Ticket Purchaser. The services provided by SEE are excluded from this. These services include the processing of financial transactions and the dispatch of tickets. Additionally, insurance contracts concluded with the respective company in connection with the purchase are also excluded.

1.2. The contract for the purchase of a ticket is based on these General Terms and Conditions and any additional terms and conditions of the Promoter. For inquiries or claims of any kind related to the events themselves, other than the processing of ticket purchases, the Ticket Purchaser must contact the respective Promoter of the event directly.

1.3. Tickets purchased on the Website may not be resold for commercial purposes. All tickets purchased are for personal use only. Unless otherwise expressly agreed, no resale (actual or attempted) or transfer (actual or attempted) of tickets is permitted. Any violation of this condition entitles SEE or the Promoter to cancel the tickets without prior notice, refund, compensation or liability.

1.4. In addition to the cost of the ticket, a service fee per ticket, a processing fee per order, and/or other additional fees applicable to the event may be incurred at the time of purchase. These will be visible to the Ticket Purchaser during the purchasing process.

1.5. In the event that a Ticket Purchaser orders or purchases more tickets than the maximum permitted per person, per card, or per household, SEE reserves the right to cancel all orders or tickets. In such an event, SEE will issue a refund for the ticket price, as well as all associated booking, processing, and additional fees. To prevent fraud and safeguard both SEE and the Ticket Purchaser, verification may be required. Ticket Purchasers may be requested to furnish supplementary information subsequent to the ordering process, such as a copy of the credit or debit card statement, thereby enabling SEE to verify the purchase. In the event of suspected fraud, any ticket or order may be cancelled. In such cases, the Ticket Purchasers will be refunded any booking, processing, or additional fees paid.

1.6. It is the responsibility of the Ticket Purchaser to ensure that their e-mail address and other details are up to date. Our preferred method of communication is e-mail. Ticket Purchasers are therefore required to ensure that they provide a valid and updated e-mail address. It is the responsibility of the Ticket Purchaser to ensure that the messages/e-mails from SEE are not treated as spam or junk mail by the respective e-mail provider.

1.7. An order for tickets is only completed when the order is accepted by SEE. SEE endeavours to ensure the accuracy of all pricing information. Errors can therefore not be ruled out. If an incorrect price is found for the tickets ordered, SEE will notify the Ticket Purchaser by e-mail. Ticket purchasers will then have the option of either cancelling the order (in which case any booking, processing or additional fees paid by the Ticket Purchaser will be refunded) or confirming the order at the correct price.

1.8. Ticket protection offered by European Travel Insurance ERV is available during the purchase process. Ticket protection is optional. SEE's role is simply to act as an intermediary for this additional product. Any claims relating to such optional ticket protection must be made directly to European Travel Insurance ERV.

1.9. It is at the discretion of the Promoter whether tickets need to be personalised. In this case, access to an event will only be granted to the person in whose name the ticket was personalised. It is the responsibility of the Ticket Purchaser to ensure that the details of all persons are entered correctly. In the case of personalised tickets, the name of the person can be printed on the ticket.

1.10. The performance or event may be filmed or recorded on rare occasions. By purchasing a ticket, the Ticket Purchaser consents to the recording of their image and sound Should the Ticket Purchaser wish to raise an objection, the Ticket Purchaser must contact a member of the relevant Promoter’s management team.

2. Payment and Delivery

2.1. The Ticket Purchaser acknowledges that the Promoter or SEE may restrict the choice of payment and delivery methods.

2.2. A Promoter can print additional information on the tickets, such as advertising or a picture. SEE is not liable for this information.

2.3. If postal delivery is an option, tickets will be shipped in a neutral envelope upon receipt of payment. Whether tickets are sent by A or B mail is at the discretion of SEE.

2.4. It is the responsibility of the Ticket Purchaser to verify that the shipping address is correct before completing the order. SEE is not responsible for any incorrect information.

2.5. If tickets sent by mail are returned to SEE with a notation such as “addressee relocated”, “addressee unknown”, or the like, indicating that the Ticket Purchaser does not reside at the address, SEE will send the tickets to the Ticket Purchaser by e-mail without a refund of the shipping charges. There is no entitlement to a reshipment by post.

2.6. The Ticket Purchaser is shown all relevant information before completing the order. The Ticket Purchaser must review this information carefully. After completing the order, the Ticket Purchaser will immediately receive an email with the order confirmation. The Ticket Purchaser must contact SEE immediately by e-mail if the Ticket Purchaser discovers any errors.

2.7. SEE is not responsible for lost or stolen tickets during or after delivery. SEE reserves the right to deny any request for the replacement of tickets.

3. Right of Withdrawal and Cancelations

3.1 Tickets that have been paid for cannot be exchanged or returned. If an event is cancelled and not re-scheduled, Article 5 shall apply.

4. Change or Postponement of an Event

4.1. The decision to hold an event is the responsibility of the respective Promoter. If the Promoter decides to postpone the event, the ticket remains valid regardless of the reason for the postponement. The decision to rebook or refund tickets is at the discretion of the Promoter. Otherwise, Article 3.1 applies.

4.2. It is the responsibility of the Ticket Purchaser to verify that an event is taking place on the scheduled day, time and location.

4.3. In the event of a postponement or other change to the event, SEE will notify all Ticket Purchasers with an e-mail address in their account of the further course of action that will be taken. This information will also be published on the SEE Website.

4.4. If the event must be ended prematurely, the Promoter is responsible for determining whether the event can be rescheduled or whether it is considered a completed performance. The premature ending of an event does not constitute grounds for a refund claim vis-a-vis SEE.

4.5. In the event of a postponement or other change to the event, SEE cannot be held responsible for reimbursement of expenses such as transportation, accommodation or similar costs.


5. Refunds for Cancelled Events

5.1 If the Promoter decides to cancel an event without substitution, the Promoter will decide on any refunds.

5.2 SEE always requires official notification from the Promoter of the cancellation of an event. Messages posted on social media channels, the artist's website or similar do not constitute an official cancellation and do not affect the refund process.

5.3 The Promoter is responsible for the refund of the purchase price of the ticket.

5.4 Once the Promoter has announced the modalities, SEE will inform all Ticket Purchasers by e-mail and publish the information on the Website. The Ticket Purchaser is required to read this information carefully and to act in accordance with the information provided.

5.5 If the Promoter decides to issue refunds via SEE, SEE will only be responsible for refunds for a limited period of time. The deadline will be published on the Website. Furthermore, all Ticket Purchasers who have provided an e-mail address will receive an e-mail reminding them of the deadline. SEE will not issue any refunds after the deadline.

5.6 If Article 5.5 applies, the claim exists exclusively between the purchaser through whose account the order was booked and SEE. Third parties have no claims against SEE.

5.7 In any case, SEE will only reimburse or credit the purchase price to the extent that SEE is permitted to do so by the regulations of the respective Promoter. No refunds or credits will be given in excess of the ticket purchase price.

5.8 In the event of a cancellation of the event, SEE cannot be held responsible for reimbursement of expenses such as transportation, accommodation or similar costs.


6. Attending an Event

6.1. SEE does not organise events and is not responsible for any loss or damage of any kind incurred at or in connection with an event (including loss, damage or theft of personal property at an event). Therefore, SEE is neither liable nor responsible for the events.

6.2. Admission to an event is always subject to the terms and conditions of the Promoter and venue operator. If the Ticket Purchaser breaches any of these terms and conditions or regulations, the Promoter or the venue operator may refuse entry to the Ticket Purchaser or ask the Ticket Purchaser or other ticket holders to leave the venue.

6.3. The tickets must be protected from moisture, dirt, mechanical or optical effects and any other kind of damage, etc. The barcode must be machine-readable. Tickets that are damaged will not be replaced. The copying, modifying or counterfeiting of any ticket is prohibited. Tickets that have been tampered/manipulated with in this or any other way are not valid.

6.4. Ticket Purchasers and other ticket holders are required to abide by health and safety regulations and all other security regulations (including acceptance of entry and security searches for the public safety reasons. The venue and the Promoter reserve the right to refuse entry or eject any ticket holder or other ticket holder from the event under certain circumstances. This is usually the case with people who are under the influence of alcohol, people who behave in a violent, dangerous or otherwise disorderly manner, people who carry weapons or illegal or prohibited substances, or people who make unauthorised audio, video or photographic recordings. There are often restrictions or exclusions on the admission of latecomers.

6.5. Ticket Purchasers and other ticket holders must carefully check all details on the tickets. When attending the event, proof of age must be on hand.

6.6. Tickets will be checked at the entrance to the event. We reserve the right to verify the identity of the person presenting the ticket.

6.7. Personalised tickets allow only the person in whose name the ticket was issued to enter the event. On-site staff have the authority to perform identity checks. Admission may be refused if the name of the person does not match the name on the ticket. This does not give rise to a right to reimbursement. The same applies if the name on the ticket is not clearly legible.


7. Personal Data

7.1. SEE may only share personal data with Promoters, venue operators, bus companies and others for the purposes of the event. Unless required by law, SEE shall not disclose this data to third parties for marketing or other purposes without the consent of the Ticket Purchaser (given during the booking process or otherwise).

7.2. The Ticket Purchaser acknowledges and agrees that in connection with the provision and maintenance of the Website and the provision of services, SEE and SEE’s suppliers may become aware of personal data. SEE endeavours to maintain confidentiality to the extent required by law and commercially reasonable. Details on the handling of personal data can be found in the SEPrivacy Policy.


8. Miscellaneous

8.1. SEE is committed to ensuring that the information provided on the Website is complete, up-to-date and correct. However, SEE does not warrant the accuracy, completeness or timeliness of the information on the Website or any transmission errors and is not liable for any damages or inconvenience resulting therefrom. The Ticket Purchaser acknowledges that SEE does not assume any guarantee for the content of the linked websites of third parties and does not accept any liability for such content.

8.2. In no event shall SEE be liable for the acts or omissions of any third party (including Promoters and venue operators).

8.3. These General Terms and Conditions do not create any rights or obligations enforceable by or against any person other than SEE, the Ticket Purchaser and the Promoter (for whom SEE is acting as an intermediary), who have direct rights and obligations arising under these General Terms and Conditions.

8.4. The Website and ticket system are protected by copyright and other intellectual property rights. All rights thereto, including but not limited to ownership and/or usage rights, are held by SEE and/or its suppliers/licensors.

8.5. SEE reserves the right to change and amend these General Terms and Conditions at any time. Should any changes to the General Terms and Conditions be made, Ticket Purchasers will be notified in a suitable manner, including by means of a notification on the Website. Ticket Purchasers must check the SEE Website regularly.

8.6. If any provision of these General Terms and Conditions is or becomes invalid or unenforceable in whole or in part, the validity and enforceability of the remaining provisions of these General Terms and Conditions shall not be affected. If any provision is invalid or unenforceable, it shall be replaced with a valid and enforceable provision that comes as close as possible to the purpose of the provision being replaced.

8.7. The purchase of tickets and these Terms and Conditions (and any contractual or non-contractual matters arising in connection with these Terms and Conditions) shall be governed by Swiss law. Any disputes arising out of or in connection with the use of the Website or the use of SEE’s services shall be settled by the courts of the place of business of SEE or the place of residence of the Ticket Purchaser, at the discretion of SEE. Excluded are conflict of laws provisions and provisions of the UN Convention on Contracts for the International Sale of Goods (CISG).
